By using ReVerbal, you agree to these Terms and Conditions. Please also read our Privacy Policy, Data Processing Addendum, AI Transparency Statement, Sub-processors, and Data Locations.
1. Service Description
ReVerbal provides classroom transcription and optional lesson summarisation. The Service is provided on an early access and evaluation basis unless otherwise agreed. Features may change, and the Service may be interrupted, modified, or discontinued from time to time.
2. Acceptable Use
You must be an adult educator or otherwise authorised to use the Service in your educational setting. ReVerbal is designed for teacher voice only. We recommend the use of a teacher-only microphone. There are no student accounts.
You must use the Service lawfully and in compliance with applicable school, education department, privacy, and child safety requirements. If you choose to capture, save, or use student personal information, you are responsible for obtaining any necessary authority, consent, notice, or approval required under applicable law or policy.
3. Data Processing and Roles
You are responsible for determining whether and how you use the Service in your classroom or educational setting, including whether any personal information is captured, stored, or shared. ReVerbal processes data on your behalf for the purpose of providing the Service.
Speech-to-text processing is performed by Deepgram in the United States. ReVerbal does not store raw audio recordings. International processing occurs. Further details are set out in our Privacy Policy, Data Processing Addendum, Sub-processors, and Data Locations documents.
4. Early Access Status
ReVerbal is provided on an early access, pilot, trial, or evaluation basis unless otherwise agreed in writing. Features may change, be withdrawn, or operate with limited functionality. You acknowledge that the Service may not be error-free, continuously available, or suitable for every classroom or educational use case.
5. Data Storage and Retention
Transcript storage is optional and controlled by the teacher.
If you choose to save transcripts, transcripts will remain available in your account until you delete them or your account is deleted, subject to any temporary backups, technical limitations, or legal retention requirements described in our Privacy Policy.
If you do not choose to save transcripts, transcripts are deleted immediately after the relevant session and are not retained by ReVerbal, except for limited transient processing, security logging, backup, or technical records reasonably required to operate, secure, troubleshoot, or improve the Service in accordance with our Privacy Policy.
On account deletion, stored transcript data will be deleted in accordance with our Privacy Policy.
6. AI and Summaries
ReVerbal does not train AI models on customer data. Summaries are generated from transcript text. ReVerbal does not profile students or use automated decision-making about students.
7. Accuracy and Limitations
The Service, including transcription and any summaries, may contain errors, omissions, delays, or formatting issues. ReVerbal is provided as an assistive classroom tool and must not be relied on as the sole or authoritative basis for high-stakes decisions, including grading, discipline, legal compliance, safeguarding determinations, or emergency response.
You are responsible for reviewing outputs and exercising professional judgment before using them.
8. Security and Incidents
ReVerbal implements reasonable technical and organisational measures to protect data handled by the Service. ReVerbal maintains an incident response process and will provide notifications where required by applicable law or contract.
9. Fees
Early access pricing or pilot pricing may apply. Trial terms, subscription terms, cancellation terms, and any applicable refunds will be communicated separately or made available at the point of purchase.
10. Intellectual Property and Feedback
You retain ownership of your content. You grant ReVerbal a non-exclusive licence to host, process, transmit, and use that content solely as necessary to provide, maintain, secure, and improve the Service.
If you provide feedback, suggestions, or ideas, ReVerbal may use them without restriction or obligation to you.
11. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy which cannot lawfully be excluded, restricted, or modified under applicable law, including the Australian Consumer Law.
To the maximum extent permitted by law, ReVerbal excludes liability for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, goodwill, business opportunity, anticipated savings, or data.
To the maximum extent permitted by law, ReVerbal is not liable for loss or damage arising from:
- errors or inaccuracies in transcripts or summaries;
- interruptions, outages, delays, or unavailability of the Service;
- your use of the Service contrary to these Terms or applicable policies;
- third-party services, infrastructure, or providers; or
- decisions made by you or others in reliance on the Service.
12. Liability Cap
To the maximum extent permitted by law, ReVerbal's total aggregate liability arising out of or in connection with these Terms or the Service is limited to the greater of:
- the total amount paid by you to ReVerbal for the Service in the 12 months immediately preceding the event giving rise to the claim; and
- AUD $100, where no fees were paid.
This cap does not apply to liability that cannot lawfully be limited or excluded under applicable law.
13. Indemnity
You indemnify ReVerbal and its officers, employees, and contractors against losses, claims, damages, liabilities, and reasonable legal costs arising directly from:
- your breach of these Terms;
- your unlawful use of the Service; or
- your infringement of any third-party rights.
This indemnity does not apply to the extent that the relevant loss was caused by ReVerbal's negligence, wilful misconduct, or breach of law.
14. Suspension and Termination
ReVerbal may suspend or terminate your access to the Service if:
- you materially breach these Terms;
- your use of the Service creates a security, legal, or operational risk;
- payment remains overdue after notice, where applicable; or
- ReVerbal discontinues the Service or a relevant part of it.
You may stop using the Service at any time and may request account deletion.
On suspension or termination, access to stored data may be limited or removed, and data will be handled in accordance with our Privacy Policy.
15. Force Majeure
ReVerbal is not liable for any failure or delay in performing its obligations to the extent caused by events beyond its reasonable control, including natural disasters, war, terrorism, pandemics, labour disputes, internet or telecommunications failures, infrastructure outages, or failures of third-party providers.
16. Governing Law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
